Acceptance of conditions

Information regarding prizes and how to enter forms part of these conditions. By participating, participants accept these conditions as well as the rules, regulations and requirements set out in the promotional material. This promotion is subject to the laws of India, and is offered only in India and no where else.
With effect from 21:00 hours on November 14, 2007, the "Moto Lucky Locket" offer has been withdrawn from the State of Tamil Nadu and Union Territory of Puduchery. No Moto Lucky Lockets will be distributed in the State of Tamil Nadu and Union Territory of Puduchery with the purchase of Motorola Products after the withdrawal of the offer. Also, no gifts will be awarded against any Moto Lucky Lockets distributed in the State of Tamil Nadu and Union Territory of Puduchery after the withdrawal of the "Moto Lucky Locket" offer.
Restrictions on entry

Entry is open only for purchases made in India during
the period of the promotion, by participants aged 18 and above.
Directors and employees of Promoter, Promoter’s authorised agencies,
and of the sponsors associated with this promotion, and the immediate
families of all such persons, are not entitled to participate
in this promotion.
Duration of promotion

The promotion begins on 1st October 2007 at 00:00hrs (IST) and ends
on 15th November 2007 at 23:59.hrs (IST) (“Promotion Period”). The promotion has been extended and now ends on 16th December 2007 at 23:59 hours (IST). For the avoidance of doubt, please note that the promotion is not being extended in the State of Tamil Nadu and Union Territory of Puduchery. In these territories, the promotion stands withdrawn with effect from 21:00 hours on 14th November 2007.
Method of Entry
Scratch card

To participate in this promotion, consumers must purchase a Motorola
handset from any authorized Motorola retailer in India
during the Promotion Period to receive a scratch card and scratch
the panel(s) on the scratch card to see if they have won a prize.
For this particular promotion, the scratch card forms a part of
a specially designed key chain/locket.

If the scratch card is a winning scratch card, the card will describe
the prize which the entrant has won. Subject to Section 19 below,
to claim the prize, the winner must present the winning scratch
card to the retailer by 30th November 2007 whereupon the retailer
will make the necessary arrangements for the winner to receive
the prize. If a winning scratch card is not presented in the manner
described and by the stipulated deadline, the prize will be forfeited,
and no appeals or correspondence will be entertained. In lieu of the Moto Lucky Locket promotion being extended till 16th December 2007, the winner can now present the winning scratch card to the retailer by 31st December 2007.

Entrants with a non-winning scratch card will not be eligible for
any prizes. The Promoter accepts no responsibility for late, lost,
incomplete, misdirected, incorrectly submitted, delayed, torn,
destroyed or illegible entries, correspondence or claims for prizes
whether due to error, omission, alteration, tampering, theft,
destruction or otherwise.

Winning entrants stand to win any one of the following list of
available prizes:-

prize: One)
1 unit Honda City ZX Exi car (Total available quantity of such
prize: 12)
1 unit TVS Star 100cc motorbike (Total available quantity of such
prize: 140)
1 unit of MOTOROKR E6 handset (Total available quantity of such
prize: 280)
1 unit of MOTOFLIP W375 Pink handset (Total available quantity
of such prize: 840)
1 pair of Fastrack sunglasses (Total available quantity of such
prize: 4480)
1 unit of a watch (Total available quantity of such prize: 7000)
1 unit of a bag (Total available quantity of such prize: 687,400)
Every scratch card
will win any one of the above prizes
Motor vehicle prizes
A total
of thirteen (13) cars, and one hundred and forty (140) motorbikes,
are being offered as prizes in this promotion. The Grand prize
is an Audi A6 2.7 TDi car. A total of twelve
(12) Honda City Model ZX Exi cars are also being
offered as prizes. In addition, the promotion offers a total of
One hundred and forty (140) TVS Star 100 cc motor bikes as prizes.
All of these motor vehicle prizes do not include insurance or
any registration and delivery charges or any other accessories
not specified. All insurance, registration and delivery charges
must be borne by the respective winners.
Publicity

The prize winners must, at the Promoter’s request, participate in
all promotional activity (such as publicity and photography) surrounding
the winning of the prizes, free of charge, and they consent to
the Promoter using their name and image in promotional material.
Age restrictions

To be eligible for the prizes, all entrants must be over the age of 18
years at the closing date of this promotion.
Risky prizes

Entrants acknowledge that there may be inherent risks in some aspects
of the prizes and that using any of the prizes may involve participating in
risky or dangerous activities. By
participating in this promotion and accepting a prize, entrants accept that
risk.
Exclusion of
liability

The Promoter and its associated agencies and companies will not be liable
for any loss (including, without limitation, indirect, special
or consequential loss or loss of profits), expense, damage, personal
injury or death which is suffered or sustained (whether or not
arising from any person’s negligence) in connection with this
promotion or accepting or using any prize, except for any liability
which cannot be excluded by law (in which case that liability
is limited to the minimum allowable by law).

Without limiting the previous paragraph, the Promoter and its associated
agencies and companies will not be liable for any damage in transit
to prizes.
Awarding prizes

Promoter may require the winner to provide proof of identity, proof
of age, proof of purchase and proof of residency when claiming
his/her prize. Identification
considered suitable for verification is at Promoter’s discretion.
Disqualification of entries

If a winning entry or the winner
are deemed not to comply with these conditions of entry the entry
will be disqualified. The
judges’ decision is final and no correspondence will be entered
into..

The Promoter may, in its sole discretion,
disqualify all entries from, and prohibit further participation
in this promotion by, any person who tampers with or benefits
from any tampering with the entry process or with the operation
of the promotion or acts in violation of these conditions, acts
in a disruptive manner or acts with the intent to annoy, abuse,
threaten or harass any other person.
Changes in prize value

Prizes are not transferable or exchangeable and
cannot be redeemed for cash. In the event for any reason a winner
does not take an element of the prize at the time stipulated by
the Promoter then that element of the prize will be forfeited
by the winner and cash will not be supplied in lieu of that element
of the prize. The Promoter accepts no responsibility for any variation
in prize value. Where a prize is unavailable for any reason, the
Promoter may substitute for that prize another item of equal or
higher value as determined by the Promoter, subject to the approval
of the gaming authorities in each state and territory, where required.
Problems affecting promotion

If for any reason any aspect of this promotion is
not capable of running as planned, the Promoter may in its sole
discretion cancel, terminate, modify or suspend the promotion,
or invalidate any affected entries. In the event of printing or
other error or irregular scratch card, neither Promoter nor its
affiliates, subsidiaries, promotion, fulfilment, judging agents
and agencies shall have any liability. If, due to printing, production
or other error, more winning game cards are distributed or more
prizes are claimed than are intended to be awarded for any prize
level as outlined in Section 7, the intended prizes will be awarded
in a random drawing from among all verified prize claims received
for that prize level. In no event will Promoter or sponsor be
obligated to award more than the number of prizes listed in Section
7. Scratch cards that are distributed where prohibited by law
or not obtained legitimately will be null and void.
Tax
statement

The Promoter accepts no responsibility for any
tax implications that may arise from the prize winnings. The winner
will be solely liable for any direct or indirect tax liability
arising in respect of any prize, and all taxes and levies relating
to use or ownership of a motor vehicle must be borne by the winner.

Unclaimed

In the event of the prize not being accepted or
claimed within fifteen (15) days of the closing date of this promotion,
the relevant winner’s entry will be deemed invalid, and no prize
will be awarded
Privacy
statement

All entries will be the property of the Promoter.
The information entrants provide will be used by the Promoter
for the purpose of conducting this promotion. The Promoter may
disclose entrants’ personal information to its contractors and
agents to assist in conducting this promotion or communicating
with entrants.
